Booking conditions of OUTDOOR ADVENTURE CC.
How to book
When you have selected and agreed to undertake one of our Outdoor Adventure programmes, or if you are satisfied with any tailor-made program, draft itinerary and price, you confirm this by fax or letter (booking formular) for you and your group. The person making any booking will, by confirming such a booking, warrant that he or she has authority to enter into a con tract on behalf of the other persons so included to make payment. The person making the booking shall by his/her signature thereof assume personal liability for the total price of all bookings made by him/her.
Outdoor Adventure CC. will then send off a confirmation and invoice to you, or the travel agent, through whom you booked. Your booking is confirmed and accepted by us if you place a 15% deposit for the value of services of an guided Safari, 25% deposit for the value of a selfdrive safari with car rental to be rendered by Outdoor Adventure CC. Final payment is due to Outdoor Adventure CC. not later than 40 days prior to departure. On receipt of your full payment, we will send detailed tour information, voucher and the final touring program - unless otherwise specified.
Cancellation
Cancellation of your booking must be in writing. Cancellations are only effective on receipt of written notification. If you cancel prior to 40 days before departure your deposit is forfeited. If your cancellation is made after the due date for full payment of your tour fare, charges will be levied. The scale of charges, expressed as percentage of the tour price, is as follows: - More than 40 days notice - Deposit forfeited - Less than 39 days - safari departure - 100%
Should you fail to join a tour or join it after departure or leave it prior to its completion, no tour fare refund can be made. Guests with outstanding balances will not be able to participate.
Change your booking
Should you wish to change to an alternative person after your booking has been confirmed, you may do so, subject to availability. EUR 50,- per Person handling fees.
Responsibility
Neither the company nor any person acting for, through or on behalf of the company, shall be liable of any loss or damage whatsoever arising from any causes whatsoever and without restricting the generality thereof. The company shall not be responsible for loss or damage arising from any errors or omissions contained in its brochure or other literature, late or non- confirmation or acceptance of bookings, loss or damage caused by delays, sickness, injury or death and whether, occasioned by negligence or not.
In addition the Company shall have the right at any time and at its discretion, to cancel any tour or the remainder thereof or make alterations in route, accommodation, price or other details. The same accounts in the event of any tour being rendered impossible, illegal or inadvisable by weather, strike, war, government or interference or any other cause whatsoever. The extra expenses incurred as a result thereof shall be the responsibility of the passengers. The Company may at its discretion and without liability or cost of itself, and at any time cancel or terminate the passengers booking. Without limiting the generality of the company, it shall be entitled to do so in the event of the illness or the illegal or incompatible behavior of the passenger, who shall in such circumstances not be entitled to any refund.
Photography
The Company reserves the right without further notice to make use of any photograph or film taken on the safari by our staff for general publicity purposes without payment or permission. We guarantee that no photographs of compromising nature will be used.
Wild animals
Please be aware that our safaris may take you into close contact with wild animals. Attacks by wild animals are rare, but no safari into the African wilderness can guarantee that this will not occur. Neither the company, nor their employees, nor agents can be held responsible for any injury or accident on the safari.
Weather
Please be aware that the desert can be characterized by severe changes in weather conditions ranging from extreme cold to extreme hot, sand-storms and rain and even snow. Such extre- me conditions are rare, but no safari into the African wilderness can guarantee that this will not occur. Neither the company, nor their employees, nor agents can be held responsible for any weather condition and no refunds shall be paid in the event of guests opting to leave early.
Changes to schedule
Although every effort is made to adhere to schedules it should be borne in mind that the Company reserves the right, and in fact is obliged, to occasionally change routes and camps on safaris as dictated by changing conditions. Such conditions may be brought about by seasonal rainfall on airfields or reservation problems.
Refunds
While the Company uses its best efforts to ensure that all anticipated accommodation is available as planned, there shall be no claim of any nature against the Company for a refund either in the whole or part, if any accommodation or excursion is unavailable or the passenger was unable to use that service.
Insurance
You must take out comprehensive insurance cover before travel for cancellation, medical expenses, personal baggage and money with your travel agent before starting a safari with OUTDOOR ADVENTURE CC. This should be arranged at the time of payment of the deposit to cover you. OUTDOOR ADVENTURE CC. as well as any other travel agent are only agents for the traveler and cannot be held responsible for any delay, accidents, illness, death, injury and losses. Therefore we recommend each traveling guest in our country to take out a spe- cial travel insurance for foreign countries to cover medical care for illness and accidents, medical care transport back to their home country, any other losses due to accidents, lugga- ge (camera and binoculars) and cancellation costs.
Airline clausel
The airlines concerned are not to be held liable for any act, omission or event during the time the passengers are not on board their planes or conveyance. The passengers tickets in use by the airline or by other carriers concerned when issued, shall constitute the sole contract between the airlines and the purchaser of these tickets and/or passengers. Please note that OUTDOOR ADVENTURE CC. sub-contracts the flying services to independent charter operations who are responsible for the flying. In the event of changes of programs and schedules, resul- ting in any additional services rendered due to airline mistake, OUTDOOR ADVENTURE CC. shall be in no way liable for costs arising from such changes and delays.
Prices
We will do our utmost to keep to the prices published. Should increases be forced on us by airlines, exchange rates, new taxes etc. we reserve the right to surcharge without notice, up to a maximum of 15% of the fare.
Not included
Unless specified otherwise, transfers, airport taxes, personal laundry, insurance, alcoholic beverages and gratuities to tour guides and to camp staff, as well as any excursion not related to the safari, personal items and optional meals in restaurants etc. are not included in the tour price.
Delays
We cannot be held liable for any delays due to airlines not running to schedule. When any incoming flights are not on time, the flying schedule of charter companies need to be rearranged, and inter lodge charter schedules may be changed.
This agreement is made subject to and shall be governed by and construed according to the laws in Namibia. The Windhoek office of OUTDOOR ADVENTURE CC. acts merely as an agent for the operating companies. Guests requiring special diets are advised to warn us well in advance of their departure. The Company can not be held responsible for any food served at any lodges or camps. For flight information on how to get to the starting point of your safari, contact our reservations office, your travel agent or your nearest airline office and ensure to re-confirm all flights. Unless transfers to and from airports at Windhoek have been booked directly through OUTDOOR ADVENTURE CC:, the company shall in no way be responsible for guests transportation to a hotel.
Consent
The payment of the deposit or any other partial payment for a reservation on a safari construes consent to all provisions of the conditions and general information contained in the OUTDOOR ADVENTURE CC. brochure.
This agreement is made subject to and shall be governed by and construed according to the laws in Namibia.
